Zogby gets busted

WASHINGTON, Feb. 5 /PRNewswire-USNewswire/ -- Zogby International, the famed polling company, was sued on January 17, 2007 for breach of contract,fraudulent inducement and unjust enrichment. The case arose out of a series of exit polls Zogby was hired to conduct during the 2006 mid-term elections for the election protection organization VelvetRevolution ("VR").
VR paid Zogby $120,000 to conduct exit polls in seven key states for the purpose of comparing those polls to the official tallies in order to help detect fraud, launch legal and public relations challenges, and convince candidates not to concede close elections. Zogby promised to conduct the polling Sunday through election-day Tuesday and have the results to VR by Wednesday morning, November 8, 2006. Zogby also said that it knew of no company that was doing exit polling.
According to the suit, Zogby never completed the exit polling. Two states, Maryland and Tennessee, were incomplete, Maryland was not even started until Friday after the election, and the others were not completed until much later than promised. (CA -- Nov. 10; MO -- Nov.13; OH -- Nov. 13; PA -- Nov. 13; FL -- Nov. 14). On November 14th, Zogby offered exit polls it had done in 26 states to anyone for a mere $75.00.
According to VR co-founder Brett Kimberlin, "Zogby defrauded us big time. They promised to have the exit polls completed by Wednesday but never got them all done. And they intentionally misled us about doing other exit polls so they could line their pockets at our expense. Finally, they co-mingled data from our exit polls with data from exit polls they did for their own marketing campaign."
The lawsuit, VELVETREVOULTION.US, et al. v. Zogby International, Inc. was filed in the Superior Court for the District of Columbia. The suit demands compensatory, consequential and punitive damages, as well as attorney fees.
