Haredi felon Malka Leifer committed sexual crimes before moving to Australia
Two new allegation of sexual misconduct that took place in an Israeli school decades ago have surfaced against former principal Malka Leifer, who is facing extradition back to Australia over multiple charges of sex abuse at a Jewish girls school there. That's what's terrible about this case too. That there's a time limit on when you can report a crime, a statute that should be eliminated. Otherwise, how else will felons be punished?
The accusations, which occurred in the Tel Aviv suburb of Bnei Brak some 20 years ago, could indicate that ultra-Orthodox leaders, some of whom have allegedly continued to protect Leifer, sent her to Australia rather than report her to authorities, which activists claim is a common practice in the insular community.
The accusations are the first to be leveled against Leifer from before her time in Australia. She cannot face prosecution over them because the statute of limitations has expired.
Manny Waks spoke about this a few weeks ago:
It was then that the games began, with Leifer’s legal team – led by one of Israel’s best-known criminal defense lawyers, Yehuda Fried – relying on a loophole in Israeli law which prevents a person who was mentally unwell from facing an extradition hearing. The court's ordered a new assessment, and UTJ member Yaakov Litzman's now under investigation for his possible role in sabotaging the case. And the disturbing law allowing Leifer to avoid extradition should be abolished. An Australian diplomat's made a point that Leifer should be sent back if Israel doesn't want to look bad from a foreign perspective. It's also horrific how a number of rabbis in Haredi communities tried to side with her, all at the expense of the victims, and what does that say about the apologists' POV? Plenty.
According to reports this was the first time in Israel that such an argument had been used by a defendant facing extradition. During multiple court hearings, Leifer’s lawyers argued that she was too unwell to participate in any hearings. Apparently, she was not even in a position to communicate. They said that she suffered psychotic episodes and panic attacks requiring her hospitalization. Medical reports were produced to support their arguments. The fact that, according to critics, her condition only arose before every court hearing did not seem to matter.
Meanwhile, Leifer’s alleged victims continued to suffer and the Israeli justice system continued to let them down. It was clear that her lawyers would try every strategy possible to delay attempts to bring her to justice. Some in the haredi community supported her, and believed that she was either the victim of false allegations, could not be extradited for some misguided halachic reason or – as we have seen in numerous cases of child sexual abuse in haredi communities – came up with other justification.
The court would do well to stop stalling everything and see to it that Leifer is sent back Down Under to face justice, and once she's jailed, nobody should selectively argue it's bad for her to be in a prison among non-Jews, just because she's of Haredi background.
